Foreign Investment Act 2020

The Foreign Investment Act 2020 is the primary legislative framework that regulates foreign direct investment in the Kingdom of Tonga. It defines the rights and responsibilities of overseas investors, outlines the procedures for obtaining a Foreign Investment Registration Certificate, and establishes conditions under which foreign entities may operate in Tonga. 

The Act includes clear provisions on prohibited, reserved, and restricted business activities, and details the administration of the foreign investment register, compliance requirements, and protections for foreign investors. It replaces the 2002 Act and aligns investment regulation with modern standards and Tonga’s international obligations.
