Foreign Investment Regulations 2016

The Foreign Investment Regulations 2016 provide the regulatory framework for implementing the Foreign Investment Act 2002

This document outlines the process for applying, issuing, transferring, and canceling a Foreign Investment Registration Certificate. It defines the Reserved List (activities exclusive to Tongan nationals), the Restricted List (activities requiring certain conditions for foreign investment), and refers to the Prohibited List under the Business Licences Act. 

It also specifies appeal procedures, administrative responsibilities, amendment and inspection rules for the investment register, and the applicable fee schedule. These regulations were issued under Section 18 of the Act and remain a critical tool in understanding the investment governance structure prior to the 2020 reform.
