Foreign Investment Regulations 2021

The Foreign Investment Regulations 2021 provide the operational framework for implementing the Foreign Investment Act 2020 in Tonga. Issued by the Ministry of Trade and Economic Development, the regulations detail the process for applying for a Foreign Investment Registration Certificate, requirements for online submissions, conditions for appointment of arbitrators, and procedures for extending implementation periods. 

They also define the Reserved List (activities limited to Tongan nationals) and the Restricted List (activities subject to equity or capital thresholds for foreign investors), and include the official schedule of prescribed fees and application forms.
